Terms and Conditions for Holistic Symphony

1. Acceptance of Terms

(a) These terms and conditions ("Terms") constitute a legally binding agreement between you ("User" or "Client") and Holistic Symphony ("Company," "we," or "us"). By accessing or using the services provided by us or by our website, the User acknowledges and agrees to be bound by these Terms. If the User does not agree to these Terms, they should refrain from using our services.

2. Services

(a) Holistic Symphony provides a range of holistic wellness services, including nutritional advising sessions, talks, cacao ceremonies, and sound healing sessions.

(b) The information provided during these sessions is for general informational purposes and personal development. It is not intended to replace professional medical or psychological advice.

3. Eligibility

(a) Users must be at least 18 years old to avail themselves of the services provided by Holistic Symphony. By accessing and using the services, the User represents and warrants that they are at least 18 years of age.

4. Payment and Fees

(a) Users are required to make advance payments for all sessions. 

(b) All fees are non-refundable, except as expressly stated otherwise in these Terms or as required by applicable law.

5. Confidentiality

(a) Personal information disclosed during sessions will be treated with the utmost confidentiality, in accordance with applicable privacy laws.

(b) The Company may use de-identified information for statistical or research purposes while ensuring the privacy of individual Users.

6. Disclaimer of Warranty

(a) Holistic Symphony's services are provided "as is," without any express or implied warranties. The Company makes no guarantees regarding the outcomes or results of the sessions.

(b) Users acknowledge that individual responses to holistic wellness practices may vary, and the Company disclaims any responsibility for the outcomes resulting from the implementation of such practices.

7. Limitation of Liability

(a) In no event shall Holistic Symphony or its practitioners be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of its services.

(b) The total liability of Holistic Symphony and its practitioners, if any, shall not exceed the total amount paid by the User for the services.

8. Termination

(a) Holistic Symphony reserves the right to terminate or suspend access to its services at any time for any reason, including a violation of these Terms or applicable law.

9. Changes to Terms

(a) Holistic Symphony reserves the right to update or modify these Terms at any time without prior notice. Users are encouraged to review the Terms periodically for any changes.

10. Governing Law and Jurisdiction

(a) These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the courts of the Netherlands.

11. Health and Safety Acknowledgment

(a) Users participating in cacao ceremonies and sound healing sessions acknowledge that these activities may have physical, emotional, and spiritual effects. Users affirm that they are in suitable physical and mental health to participate in these sessions.

(b) Users with known medical conditions or those who are pregnant should consult with a healthcare professional before participating in cacao ceremonies or sound healing sessions.

12. Cacao Ceremony Specifics

(a) Users participating in cacao ceremonies understand that cacao contains natural compounds that may affect mood and energy levels. Users should follow any guidelines provided by the facilitator and refrain from excessive consumption.

(b) Holistic Symphony is not liable for any adverse reactions resulting from cacao consumption during ceremonies.

13. Sound Healing Session Considerations

(a) Users participating in sound healing sessions acknowledge that certain frequencies and vibrations may elicit emotional responses. Users should communicate any discomfort to the practitioner during the session.

(b) Individuals with certain medical conditions, such as epilepsy or severe mental health disorders, should consult with a healthcare professional before participating in sound healing sessions.

14. Energy Exchange

(a) Users understand and agree that holistic wellness services involve an energy exchange. Payment for services is considered a reciprocal exchange supporting the practitioner's time, expertise, and resources.

15. Session Recording

(a) With prior consent from Users, Holistic Symphony may record sessions for quality assurance, training, or research purposes. Recordings will be handled in accordance with the privacy policy.

(b) Users may request not to be recorded during sessions by notifying the practitioner in advance.

16. Code of Conduct

(a) Users agree to engage in sessions with respect and openness, fostering a safe and supportive environment for both themselves and practitioners.

(b) Holistic Symphony reserves the right to terminate a session if a User's behavior is disruptive, disrespectful, or violates these Terms.

17. Venue and Equipment

(a) Users participating in virtual sessions are responsible for ensuring they have a suitable and secure environment and necessary equipment for an uninterrupted session.

(b) Holistic Symphony is not liable for technical issues or disruptions caused by the User's equipment or internet connection.

18. Event Cancellation Policy

(a) In the event that Holistic Symphony needs to cancel a scheduled session or event, Users will be notified promptly, and a refund or rescheduling option will be offered.

(b) Users are encouraged to provide reasonable notice if they need to reschedule a session to facilitate better scheduling arrangements.

19. Holistic Symphony Intellectual Property

(a) All content provided by Holistic Symphony, including but not limited to session materials, recordings, and written content, is the intellectual property of the Company and is protected by copyright laws.

(b) Users agree not to reproduce, distribute, modify, or create derivative works from Holistic Symphony's content without the express written consent of the Company.

20. Client Feedback and Testimonials

(a) Users may voluntarily provide feedback or testimonials about their experiences with Holistic Symphony. By providing such feedback, Users grant the Company the right to use, reproduce, and display the feedback for promotional or informational purposes.

21. Privacy Policy

(a) Users are encouraged to review Holistic Symphony's Privacy Policy, which outlines how personal information is collected, used, and protected. The Privacy Policy is an integral part of these Terms.

(b) The Privacy Policy is available on the Holistic Symphony website.

22. Affiliate Relationships

(a) Holistic Symphony may engage in affiliate relationships with third-party products or services. Any recommendations or endorsements provided by the Company are made in good faith, and Users are encouraged to conduct their own research before making any purchasing decisions.

23. Force Majeure

(a) Holistic Symphony shall not be liable for any delay or failure to perform its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of nature, war, terrorism, labor disputes, or technical failures.

24. Professional Liability

(a) Practitioners associated with Holistic Symphony are trained and qualified in their respective fields. However, Users understand and acknowledge that holistic wellness practices are subjective, and outcomes may vary.

(b) Holistic Symphony and its practitioners shall not be held liable for any professional malpractice claims.

25. Termination of Services

(a) Holistic Symphony reserves the right to terminate or suspend access to its services for any reason, including but not limited to a violation of these Terms or applicable law.

(b) In the event of termination, Users will be notified, and any applicable refunds or rescheduling options will be provided.

26. Amendments to Services

(a) Holistic Symphony may, at its discretion, introduce new services, modify existing services, or discontinue certain services. Users will be notified of significant changes.

27. Local Regulations and Customs

(a) Users are responsible for ensuring that their participation in Holistic Symphony's services complies with local regulations and customs in their jurisdiction.

28. Governing Language

(a) In the event of any discrepancy between translated versions of these Terms, the English version shall prevail.

29. Entire Agreement

(a) These Terms constitute the entire agreement between the User and Holistic Symphony and supersede any prior agreements, understandings, or representations, whether oral or written.

30. Severability

(a) If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

31. Waiver

(a) The failure of Holistic Symphony to enforce any provision of these Terms shall not be considered a waiver of its right to do so. No waiver by the Company of any term or condition shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

32. Dispute Resolution

(a) In the event of a dispute arising out of or relating to these Terms, the parties agree to attempt to resolve the dispute through negotiations in good faith. If the dispute cannot be resolved through negotiations, it shall be submitted to binding arbitration in accordance with the rules of the Netherlands, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.

(a) Sections of these Terms that by their nature should survive termination, including but not limited to confidentiality, indemnification, and limitations of liability, shall survive any termination or expiration of these Terms.

(a) Holistic Symphony reserves the right to update or modify these Terms at any time. Users will be notified of significant changes, and continued use of the services after such modifications constitute acceptance of the updated Terms.

35. Communication Preferences

(a) Users may manage their communication preferences, including opting out of non-essential communications, by contacting Holistic Symphony's customer support or following the provided instructions in communication materials.

36. Event Participant Responsibilities

(a) Users participating in events organized by Holistic Symphony, whether in-person or virtual, are responsible for their own well-being during the event. Users should adhere to any guidelines provided by event organizers.

37. Venue Change or Cancellation

(a) Holistic Symphony reserves the right to change the venue or cancel an event due to unforeseen circumstances. In such cases, Users will be notified promptly, and applicable refunds or rescheduling options will be provided.

38. Third-Party Platforms

(a) Users engaging with Holistic Symphony through third-party platforms (e.g., social media) are subject to the terms and conditions and privacy policies of those platforms. Holistic Symphony is not responsible for the policies of third-party platforms.
